Senate budget committee chairman refuses to cut correctional officers<br />

The chairman of the Senate Budget Committee declared Gov. Scott’s plan to fire hundreds of correctional officers “dead on arrival.”<br />

TALLAHASSEE -- Gov. Rick Scott’s plan to overhaul Florida’s prison system, in part by firing hundreds of correctional officers, hit a wall of resistance Thursday.<br />
The chairman of the Senate budget committee that oversees prisons, Republican Sen. Mike Fasano of New Port Richey, declared the idea “dead on arrival,” as he clashed with John Thrasher, a powerful colleague who endorsed the proposal. <br />
Scott’s plan would save $135 million by firing 1,700 employees, increasing probation officers’ caseloads, cutting wardens’ pay by 5 percent and shifting up to 1,500 inmates from state-run prisons to private, for-profit lockups, which are required to operate at 7 percent less cost than state prisons. <br />
The governor wants to use the savings to expand drug treatment, mental health, literacy and re-entry programs for inmates so they will be less likely to commit new crimes and return to prison. <br />
Fasano expressed shock when Scott budget aide Bonnie Rogers defended putting more inmates in private prisons, so as to save $2.8 million by dismissing 619 prison guards, even though state prisons have thousands of unused beds. <br />
“What the governor wants to do is put 619 families on the unemployment line so we can move prisoners from the public sector to the private sector,” Fasano said. <br />
Rogers, former chief of staff in the Department of Corrections, said the seven private prisons can reconfigure their space to house up to 1,500 more inmates. The private prisons are paid per inmate housed — meaning potentially more profit for the private firms. <br />
Fasano and Thrasher, former chair of the Republican Party of Florida, had an ugly exchange after Fasano badgered the prison system’s new No. 2 official, Dan Ronay, for not controlling overtime, even though he has been on the job four days. <br />
A scathing audit of prison overtime costs said 25 medical workers collected $2 million in overtime last year — the equivalent of $90,000 per worker. <br />
Ronay called that “atrocious,” but that did not placate Fasano, who as committee chairman dominated the questioning and continued to hammer away. <br />
“That is not fair to him,” Thrasher told Fasano. Then Thrasher sought to pin the blame for prison woes on former Gov. Charlie Crist, a Fasano ally whom Thrasher actively opposed last fall after Crist bolted from the Republican Party. <br />
When Thrasher mentioned “a governor who left us who ran for something else,” Fasano cut him off abruptly. <br />
“Oh, Sen. Thrasher, we’re not going to get into politics today,” Fasano said. <br />
“We’re not playing politics,” Thrasher said. <br />
Democratic Sen. Arthenia Joyner of Tampa faulted Scott’s team for advocating the shutdown of a juvenile detention center in eastern Hillsborough County to save money. Rogers sought to mollify Joyner, saying: “It was certainly not a target to your district.” <br />
PBA lobbyist Ken Kopczynski praised Fasano for grilling Scott’s team. “I think he held their feet to the fire,” he said. <br />
Senate President Mike Haridopolos, asked whether Fasano can single-handedly thwart a major part of Scott’s agenda, said: “If he can sway 21 members that something is a bad idea, then he’ll get his agenda done,” Haridopolos said. <br />

I want to make my position perfectly clear- I DO NOT have a defeated attitude nor am I willing to allow our members to be mowed over by anyone, including the governor! For every action, there needs to be a reaction. Our fight is a long one and we must act with our brains, not our emotions. I want to see the whites of their eyes...<br />
 <br />
There is no better time to see who in the legislator is friend or foe. We will use all our resources, our manpower and our skills to protect each and everyone that is brave enough, strong enough and proud enough to pin on a badge!<br />
 <br />
We are the PBA, we are second to none and we are expected to lead. I will be the first in line and I do NOT want to hear a defeated attitude from anyone- we have not lost, we have not yet confronted our enemy and we are not done fighting!<br />

            <title>PBA responds to Gov&apos;s proposed budget</title>

                <![CDATA[Florida PBA responds to Governor's budget proposal<br />
 <br />
By now most of you know that the Governor has proposed major changes to the Florida Retirement Plan. The PBA is well aware of this and has been meeting with legislative leaders to educate them on the ramifications of these changes.<br />
 <br />
On Monday, Feb 7th, the Governor released his formal budget proposal. The proposed budget includes an $84 million cut to the Department of Corrections budget and the loss of 1,690 positions across the board.<br />
 <br />
"The PBA is committed to ensuring that there will be no cuts to the Department that will jeopardize public safety or employee positions," said Florida Correctional Officers Chapter President Jim Baiardi.<br />
 <br />
"DOC has been taking hits over the last couple of years and the Department will not be able to maintain the safety of the public if the legislature accepts the Governor's proposal," continue Mark Alfieri, Florida Correctional Probation Officer's Chapter President.<br />
 <br />
The PBA wants its members to stay calm and understand this is only a proposal by the Governor. The Legislature is the government body that crafts the official state budget. As you read this email, we are working with and educating the legislators on the need to hold the Corrections budget harmless by keeping officers on the streets and in the prisons.<br />

1) For all FRS employees: <br />
• All employees will contribute 5% in pension <br />
• New employees mandated to defined contribution plan<br />
• Special risk accrual drops from 3% to 2%<br />
• DROP closed to new participants on July 1, 2011<br />
• COLA eliminated on retirement service earned after July 1, 2011<br />
(example - Employee has 10 years in FRS before July 1, 2011, you will receive COLA for that 10 years)<br />
• Health Insurance Subsidy (HIS) credit will no longer accrue after July 1, 2011<br />
(example - Employee has 10 years in service before July 1, 2011, you will receive HIS credit that 10 years)<br />
2) For all State FRS Employees (in addition to the pension changes noted above):<br />
• On January 2013, all new employees will enter a defined contribution plan for health insurance<br />
(example - State will pay you $5,000 a year "total" for insurance regardless of dependent status)<br />
3) For all State FRS Retirees:<br />
• Retirees will pay an additional 20% into the state group health insurance plan<br />
(note - Retirees already pay 100% of the insurance premium)<br />

            <title>Is Florida about to Privatize Regions 1 and 4?</title>

                <![CDATA[A new study jointly published by Florida TaxWatch and the Reason Foundation suggests that Florida could resolve many of its prison problems by contracting with private companies to provide a "continuum" of services and saving about $1 billion over ten years. <br />
<br />
Calling it a "bold new approach," the study suggested that Florida could convert two of its four regional systems -- one in the Panhandle and the other in South Florida -- to allow private companies to provide all services: incarceration, health care, drug treatment, preparation for a return to society and the monitoring of those released to communities. <br />
<br />
This so-called "bold study" was funded in part by the private prison industry. According to the most recent information about funding for the Reason Foundation, two of Florida's private prison vendors: the GEO Group and Corrections Corporation of America, were "Platinum" and "Gold" sponsors of the Reason Foundation, respectively. <br />
<br />
The PBA wants you to understand that while this report raises some very serious concerns over the privatization of two DOC regions, it is only a recommendation from a biased study (our opinion). <br />
<br />
The Governor's budget proposal is scheduled to be released next Monday (February 7). At that time we will know what the State of Florida is proposing - which is what really matters. If the Governor's budget includes the Reason/TaxWatch proposal or anything similar to it, we will need your help in contacting his office to let him know that this proposal is un-acceptable. <br />

                <![CDATA[Announced today, the Governor's Budget will include these changes to State and Local Pension Plans:<br />

* Current employees will contribute 5% <br />
<br />
* DROP will be eliminated<br />
<br />
* Special Risk drops from 3 to 2 percent accrual <br />
<br />
* New employees will not be allowed into the Defined Benefit Plan<br />
<br />
* COLA for current retirees remains, but NO COLA for new retirees<br />
<br />
Details have not been released yet (scheduled release on Monday, February 7th).<br />

PBA Mourns loss of Correctional Colonel Malloy<br />
<br />
On Feb 2nd State Correctional Colonel Greg Malloy was shot to death while attempting to capture a murder suspect in Holmes County. Colonel Malloy, a 22-year veteran of the State Department of Corrections was part of a K9 unit in pursuit of the suspect. The suspect was also killed. <br />
<br />

"Correctional officers put their lives on the line daily," said Florida PBA State Correctional Officers Chapter President Jim Baiardi. "Our officers go behind razor wire and are locked up with violent criminals every day. It's a shame that the public seems to only take an interest in correctional officers when one is killed."<br />
<br />
Correctional officers play a key role in keeping the public safety as we have seen by Colonel Malloy giving his life to protect the public. In less than two weeks, five law enforcement officers in Florida have been killed.<br />
<br />
The PBA asks the public to please keep Colonel Malloy's family, and every officer who puts their life on the line everyday to keep us safe, in your prayers.<br />

PBA Leaders Persuade Sponsor to withdraw his legislation, pledge to work together in the future.</title>

By now you have almost certainly heard of and are very concerned about HB 303 by Representative Fred Costello (Republican), a bill that would have changed pension plans in these significant ways: <br />
<br />
<br />
Raised normal retirement age to 55 <br />
<br />
Eliminated the DROP completely <br />
<br />
Reduced the 3% accrual rate down to 1.6% for everyone including Special Risk <br />
<br />
<br />
Capped employer contributions at 15% (most employer contributions are now higher) <br />
<br />
<br />
Removed overtime from pension calculations <br />
<br />
<br />
Changed the rules on extra benefits with 185 premium tax dollars (local municipal police pension plans) <br />
<br />
<br />
Changed pension board trustee membership (local municipal police pension plans) <br />
And so on... <br />
<br />
<br />
<br />
<br />
We felt these pension reforms were extreme, so PBA leaders met with Representative Costello this morning to share our concerns. Representative Costello indicated a willingness to address our issues and work with us to craft legislation that helps alleviate the current budget deficit while protecting your hard earned retirement benefits. <br />
The Florida PBA convinced Representative Costello to withdraw his bill in exchange for our pledge to work with him on future pension legislation. We are very appreciative to him for giving us an open door and showing a sincere willingness to cooperate on this huge issue. <br />
<br />
<br />
The next step will be a meeting between PBA, House Government Operations Committee Chairman Jimmy Patronis, and Representative Costello to offer our ideas and listen to theirs on pension reform. <br />

                <![CDATA[I would like to thank you for allowing Melissa and I on Monday to join the Hollywood Police family in the caravan to the American Airlines Arena in supporting  the families and honoring the two Miami Dade Officers that lost their life's  in the line of duty. This truly meant a lot to us, thanks to Manny Marino that offered us to join him. I know it has been a rough week for all of us once again.<br /><br />

Today January 26th is a sad/happy day for me; Alex would have been turning 34 years old. Even though he is not here physically I will continue celebrating his life and what he stood for, and you know it what to love others, serve and protect us.  In his honor and memory I ask you to help me honoring him and all the other fallen officers, by letting the Hollywood Police family know that exactly in one month from now on February 26th we can all honor Alex and all the other fallen officers at the Police Expo-5K Walk/ Run for the Officer of their choice, we will be making history as we also ground break the Law Enforcement Memorial of Broward County on that day! <br /><br />

This memorial will pay tribute to dozens of heroes that have made the ultimate sacrifice for our community. This is a dream come true to surviving families like us!  We will be able to go to a tranquil setting and pay respect to our heroes! When I want to go and reflect and honor him I rather go to a setting like this and not a cemetery where I think of death which surrounds me there, and or the site where Alex lost his life where I am reminded of the terrible tragedy. <br /><br />

I need the Hollywood Police Family to support me not only on this day but to also support the building of this memorial, we need ongoing support. I know that the Hollywood Police Family will never let us stand alone on something so meaningful for all surviving families.  <br /><br />

May God continue protecting each one of you daily as you go out and face the daily dangers to protect our community!  You are our heroes' everyday!<br />
A special thanks to The Police Honor Guard of Broward County Florida in their vision to construct a Law Enforcement Memorial for Broward County for Police Officer & K9.<br />

            <title>November President’s Letter</title>
            <description>We’re not in Kansas anymore! The elections are finally over. While riding back to the PBA from the airport after spending election night at Alex Sink’s event in Tampa, we observed a flock of buzzards circling&lt;br /&gt;
above the Secret Woods Nature Center. Someone said “It must be winter, the buzzards are out.” I responded, “They’re circling our pensions!” While in Tampa I ran into one of our Broward legislators. Realizing the possibility of a Republican majority in the State Senate, State House and the Governor’s office, he told me that last year the Republicans walked all over us; this next year not only will they walk over us but they’ll kick us as they go by. In the State House the Republicans enjoy an 81-39 majority and a 28-12 majority in the State Senate. Republican State Senator Mike Bennett, who last session filed several bills to change FRS and municipal pensions, has already began filing identical bills for 2011. Last session the PBA was able to kill some of these bad bills while others were vetoed by Governor Crist. Now with Governor Rick Scott, Senate President Haridopolos and House Speaker Cannon, 2011 looks to be the bleakest session in our history as far as pensions and benefits for law enforcement employees are concerned. How bleak? You may not see buzzards circling, but don’t be surprised to see flying monkeys around the Capitol. To be blunt, to those who voted for PBA endorsed candidates, thank you. To those who voted against the PBA candidates or those who just didn’t bother to vote: When all you have worked for is gone, live with it. November is the season to be thankful for all we have and to hope for future success and happiness, despite our current economic situation. Please take time to enjoy your family and friends and have a wonderful Thanksgiving.&lt;br /&gt;
One of the reasons you can celebrate Thanksgiving is through the sacrifice of our veterans. On November 11, our country will observe Veterans Day. In 1921, an unknown American soldier killed during World War 1 was buried in Arlington National Cemetery. Similar ceremonies took place on the same day in England and France. These events celebrated the ending of World War 1: 11 a.m., November 11, 1918 (the 11th hour of the 11th day of the 11th month). On this day let us remember the sacrifices of all those who fought so valiantly to preserve our heritage of freedom. Remember to keep those who are serving in the United States Armed Forces in your thoughts and prayers and also pause a moment to remember those brave souls who have not yet returned home – POW, MIA, KIA. Since 1972, the Broward County PBA has been the “Voice of Law Enforcement”. We are proud to represent each and every one of you who is brave enough, proud enough and strong enough to wear the badge. You are among the best in Broward County, the State of Florida and the nation. I thank each of you and your families for your sacrifices, your hard work and the risks you take.</description>

            <description>Tampa, FL -&amp;nbsp;&amp;nbsp;Floridians can&apos;t trust Rick Scott. In two new ads released today by the Florida Democratic Party, Florida prosecutors and law enforcement officials speak out about Rick Scott&apos;s refusal to be open and honest with Floridians. In order to hide his record of fraud and mismanagement, Scott has spent millions of dollars lying about Alex Sink in his deceptive attack ads.&amp;nbsp;&amp;nbsp;He also claims he didn&apos;t know the company he led was systematically ripping off seniors and taxpayers, but pleaded the Fifth Amendment to avoid incriminating himself 75 times in a single deposition. &lt;br /&gt;
&lt;br /&gt;
&quot;Rick Scott is lying about Alex Sink and lying about his own record,&quot; said Kyra Jennings, Press Secretary at Alex Sink for Governor.&amp;nbsp;&amp;nbsp;&quot;To avoid incriminating himself against charges of defrauding seniors and taxpayers at his former company, Rick Scott took the Fifth Amendment 75 times in a single deposition. The truth is, you don&apos;t do that unless you&apos;re scared of being charged with a crime. Florida law enforcement knows Rick Scott is lying and they are supporting Alex Sink because she is the only candidate with the honesty and integrity to lead our state.&quot;&lt;br /&gt;

Sink is the first Democratic gubernatorial candidate in 20 years to receive the endorsement of both of Florida&apos;s major law enforcement organizations, the Police Benevolent Society (PBA) and the Fraternal Order of Police (FOP).&amp;nbsp;&amp;nbsp;Sink has also been endorsed by a bipartisan group of 24 sheriffs, some of whom appear in the ads.</description>
